Welcome to Cafe Collective, Inc. (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of our website, services, and marketplace (collectively, the “Services”). By creating an account, making a purchase, or otherwise using our Services, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old to use our Services.
Wholesale membership is available only to verified business entities, and applicants must provide a valid business name, address, and resale license number.
We reserve the right to deny or revoke membership at our discretion if false or misleading information is provided, or if account activity violates these Terms.
2. Membership Access and Termination
Membership accounts are required for wholesale purchases.
We may suspend or terminate your account without notice if we determine that you have violated these Terms, engaged in fraudulent activity, or used the Services in a manner that may harm us, our suppliers, or other customers.
Termination does not affect any outstanding payment obligations.
3. Orders, Returns, and Refunds
All orders are fulfilled via drop-shipping from our suppliers directly to you.
Due to the nature of food products and certain cafe supplies, all sales are final unless the product arrives damaged, defective, or incorrect.
To request a return or refund, you must contact us at [support@cafecollective.co] within 5 business days of delivery. You may be required to provide photographs and other documentation of the issue.
Refunds, if approved, will be processed to your original payment method within 7–10 business days.
4. Payment Terms
All payments are due at checkout via approved payment methods (Stripe, PaySafe).
You agree to provide accurate and complete payment information and authorize us to charge your selected payment method for all purchases.
5. Product Availability
Product descriptions and availability are subject to change without notice.
We are not liable for delays or inability to fulfill orders due to supplier issues, shipping delays, or events beyond our reasonable control.
6. Disclaimers
All products are sold “as is” without warranties of any kind, except as required by law.
We do not guarantee that our Services will be uninterrupted, error-free, or secure at all times.
We are not responsible for the acts or omissions of third-party suppliers or shipping carriers.
7. Limitation of Liability
To the maximum extent permitted by law:
We are not liable for indirect, incidental, special, or consequential damages arising out of your use of our Services.
Our total liability for any claim arising out of or relating to these Terms will not exceed the total amount you paid to us in the 3 months preceding the claim.
8. Governing Law
These Terms and any dispute arising from them will be governed by and construed under the laws of the State of California, without regard to its conflict of law principles.
9. Changes to These Terms
We may update these Terms at any time by posting the revised version on our website. Continued use of our Services after changes are posted constitutes acceptance of the updated Terms.
